Questions you might be asking

Do I Have A Claim?

Were you injured by the fires or did you have personal property or real property that was damaged by the fires? If so, you may have a claim. Here, “property” includes your land, house, facilities, personal belongings, vehicles, equipment, animals, crops, etc.

Who Is Responsible for My Damages?

Early reports suggest that this devastating fire may have been started by poorly-maintained powerlines. If this information is confirmed, every property owner impacted by the fire will be entitled to recover their losses from the irresponsible energy conglomerate who started the blaze.

Property owners may also be entitled to collect insurance proceeds from the insurance policies covering their properties (e.g. homeowner’s insurance, business insurance, crop insurance, livestock insurance, etc.). In large-scale disasters like this, tens of thousands (if not millions) of property owners may be making insurance claims at roughly the same. The high volume of claims will overwhelm the insurance companies who will try desperately to “low-ball” their insureds and pay out as little as possible. That’s when skilled litigation attorneys can represent property owners and advocate for a fair insurance payout.

How Will I Pay For An Attorney?

Our attorneys handle all cases on a contingency fee basis. That means, you don’t owe us anything unless you WIN. Our attorneys will represent your family and pay all of the expenses involved in bringing your claim. In the end, you won’t owe any attorneys’ fees or expenses unless we successfully recover money on your behalf.

Claim Eligibility

If you’ve suffered injury or property damage from the fires, you likely qualify to file a claim. Your losses may encompass various aspects of your life – from personal belongings to real estate and more.

Establishing Liability

Reports indicate potential negligence in powerline maintenance as a cause of the fire. If confirmed, affected property owners can seek compensation from the responsible energy company. Skilled litigation attorneys can also help navigate insurance claims against overwhelming insurance company tactics.

Documenting agricultural losses

Landowners who have experienced Panhandle wildfire losses to agricultural infrastructure or livestock are advised to properly document losses in preparation for filing insurance claims or qualifying for federal assistance.

Residents, commercial businesses and agricultural producers can utilize the Individual State of Texas Assessment Tool, iSTAT, Damage Survey. The information provided in the survey allows emergency management officials to understand damages that have occurred, helps officials determine if the state meets federal requirements for various forms of disaster assistance and identifies any immediate resource needs.

Livestock death loss documentation

Livestock owners could be eligible for federal assistance, so they should record all pertinent information of livestock death losses due to wildfire. Documentation of the number and kind of livestock that have died, supplemented, if possible, by such items as, but not limited to:

  • Purchase records
  • Veterinarian records
  • Bank or other loan documents
  • Rendering truck receipts or certificates
  • Production records
  • Records assembled for tax purposes
